Introduction and General Guidelines
This policy is to establish guidelines for MIMOSALECRIM LDA (“Company”) ‘Know Your Client’ (“KYC”) procedures for new and existing clients. The Company
operates with integrity and is committed to implementing the measures established. iF the Client’s failure to comply with the regulations set by the
Company would mean termination of the business relationship.
Restricted Business:
Our Company does not provide services to clients that their activities are associated with any banned activities as the follow:
● Any illegal activities (such as: drug, marijuana, traffic, sale of organs, protected animals etc)
● Child pornography
● Companies active in defense and military, weapons, arms and armament
● Companies listed on the EU, UN and OFAC sanction lists
● Companies operating in bank guarantees /debt securities, pass letters, medium-term credit notes (MTN)
● Companies operating/selling/linked with prohibited countries (commodity trade, travel agencies, embassies, etc…)
● Companies supporting illegal activities (counterfeiting, sale of organs, trademark infringements, etc…)
● Companies using deceptive marketing practice or blurry sales terms and conditions (such as offering a gift or goods at a cheap price to bind
customers to a long-term subscription because of unclear or blurry terms and conditions)
● Non-regulated gambling / betting / casinos
● Ponzi / Illegal Pyramid Schemes
● Unregistered Charities
● Non-regulated Crypto
Restricted Jurisdictions:
Furthermore, the Company does not accept clients from black list countries, including but not limited to the following countries:
● Afghanistan
● Belarus
● China
● Crimea
● Cuba
● Democratic Republic of Congo
● Iran
● Iraq
● North Korea
● Rusia
● Syria
● South Sudan
● Sudan
● United States
● Zimbabwe
KYC Procedures
The KYC procedure is a requirement in order to comply with the International law provisions, including the ones designed to prevent money laundering.
The following should be followed unless an amendment is sent from the Compliance Department stating otherwise. The Company’s KYC and due
diligence procedures are applied by the Company’s Back Office when accepting clients for the provision of consultancy services.
Natural Persons:
Proof of Identity
Is any document which may be used to prove a person’s identity. Such documents are:
● For EU citizens, a national identification card;
● For all other countries a passport.
Proof of Residence
Proof of residence is a document confirming where the client lives. It needs to have both the name of the individual and his/her address printed on it. Such
documents are:
● Recent Utility Bill as water, electricity and gas;
● Bank Statement, bank reference letter;
● Local Authority Tax Bill, municipality bill where home address is shown.
Legal Entities:
Incorporation documents must be collected. Such documents are:
● Certificate of incorporation or equivalent;
● Certificate of registered office or equivalent;
● Certificate of directors or equivalent;
● Certificate of shareholders or equivalent;
● Memorandum and articles of association of the legal person;
● Recent copy (up to three months) of a bank statement or utility bill in order to verify the head office address;
● Identity of Directors and Shareholders with their relevant KYC documents required of Natural Persons.
